1. Acceptance
These Terms of Use (the "Terms") form a binding agreement between you ("you", "user") and MyDL.ca ("MyDL.ca", "we", "us", "our"), a free educational website operated by an individual based in Canada (the "Operator"), governing your access to and use of https://mydl.ca and any related services (the "Service"). By accessing, browsing, or using the Service in any way — whether or not you create an account, and whether or not you have read these Terms in full — you confirm that you accept these Terms and the Privacy Policy in their entirety, without modification, qualification, or reservation. If you do not agree, your sole option is to stop using the Service immediately. No partial acceptance is permitted.
2. Free Service — No Consideration
The Service is provided free of charge. No payment, fee, subscription, or other monetary or non-monetary consideration has been or will be paid by you to the Operator. Accordingly, the Service is provided on an entirely no-warranty, no-liability, no-refund, no-compensation basis. If at any time you are dissatisfied with the Service, any feature, any change, any outcome, or any other aspect of it, your sole and exclusive remedy is to stop using the Service. No refund, credit, indemnity, or compensation of any kind, whether monetary or otherwise, is or will ever become available.
3. No Reliance, No Advice, No Relationship
You acknowledge and agree that: (a) you have not relied, and are not entitled to rely, on any statement, representation, warranty, prediction, or other communication made by or on behalf of MyDL.ca or the Operator, whether on the Service, in marketing, in correspondence, or anywhere else; (b) nothing on or related to the Service constitutes legal, medical, financial, insurance, professional driving instruction, or any other professional advice, and no professional relationship of any kind is created; (c) no agency, partnership, joint venture, employment, fiduciary, or other special relationship exists or arises between you and MyDL.ca or the Operator; and (d) the Operator owes you no duty of care, loyalty, or good faith beyond what is non-waivable under applicable law.
4. Eligibility, Capacity, and Minors
By accessing or using the Service in any way, you represent and warrant that either: (a) you are of legal age and have full legal capacity to enter into and be bound by a binding contract in your jurisdiction; or (b) you are a minor whose parent or legal guardian has reviewed these Terms and the Privacy Policy in their entirety, expressly agrees to be bound by them on your behalf, and assumes full and unconditional responsibility for your use of the Service, your compliance with these Terms, and any direct or indirect consequence of your use, including but not limited to any liability, indemnity, and waiver under these Terms.
The Operator does not verify, and has no obligation to verify, any user's age, identity, capacity, or guardian consent, and accepts no liability for any user's breach of the foregoing representation. Any breach of this section is a material breach of these Terms and grounds for immediate termination at the Operator's sole discretion. The Service is for personal, non-commercial educational use only; any other use is prohibited.
5. The Service — Independence
MyDL.ca is an independent project. It is NOT affiliated with, endorsed by, sponsored by, certified by, or connected in any way to any federal, provincial, or territorial government, ministry, agency, or licensing authority — including but not limited to the Ministry of Transportation of Ontario, DriveTest, ICBC, the Insurance Corporation of British Columbia, the Société de l'assurance automobile du Québec (SAAQ), Manitoba Public Insurance, Saskatchewan Government Insurance (SGI), Service Alberta, Service New Brunswick, Service NL, the Registry of Motor Vehicles (Nova Scotia), the Highway Safety Division (PEI), or the Motor Vehicles divisions of Yukon, the Northwest Territories, or Nunavut.
6. Account
Some features require sign-in via Google. You are solely responsible for everything that occurs under your account, for keeping your Google credentials secure, and for using only one account per natural person. You must not share, sell, transfer, sublicense, or otherwise dispose of your account. You authorize the Operator to take any action deemed appropriate, in its sole discretion, to investigate suspected misuse, including immediate suspension, account freezing, data preservation, deletion, and disclosure of information as required by law or in response to valid legal process.
7. Acceptable Use
You agree not to:
- Scrape, copy, mirror, archive, cache, store, or redistribute the Service or any of its content using any automated means or AI agent
- Reverse-engineer, decompile, or attempt to derive the source code, algorithms, or non-public APIs
- Probe, attack, stress-test, or attempt to disrupt the Service or its infrastructure
- Create accounts using false identities, automated means, or any deceptive practice
- Abuse the referral or cars system through self-referral, fraud, multi-accounting, or any deceptive means
- Use the Service for any commercial purpose without the Operator's prior written consent
- Misrepresent the source, accuracy, completeness, or affiliation of the Service or its content
- Upload or transmit malicious code, harmful content, or anything unlawful, defamatory, infringing, or hateful
- Violate any applicable law or third-party right
- Engage in any other use which the Operator, in its sole and unappealable discretion, determines to be inconsistent with the spirit or letter of these Terms or harmful to the Service, the Operator, other users, or any third party
The Operator may suspend or terminate any account at sole discretion, with or without notice and with or without reason or any obligation to state a reason.
8. No Guarantees — Educational Use Only
The Service is provided for educational and self-study purposes only. Practice questions, explanations, scoring, and any other materials on the Service:
- Are not the actual government test, the actual government questions, or any substitute for any actual government test
- Are not certified, validated, approved, audited, or endorsed by any government agency
- May not reflect the current content, format, scoring, weighting, or rules of any provincial knowledge test, all of which can change at any time without notice
- Do not guarantee any outcome on the actual test, the road test, the licensing process, or any subsequent licensing decision
No professional advice. Nothing on the Service constitutes legal, medical, insurance, professional driving instruction, or any other professional advice. Provincial driving rules, test content, scoring, eligibility criteria, and licensing requirements can change at any time without notice. No representation is made that any information on the Service is accurate, complete, current, or reliable at any given time.
Reliance disclaimer. Reliance on the Service alone is entirely at your own risk. The only authoritative sources are the official driver's handbooks, regulations, and licensing authorities of each province or territory.
Assumption of risk. You assume all risk arising from your use of, or reliance on, any information obtained through the Service — including without limitation any traffic incident, collision, injury, fine, fee, suspension, criminal charge, or property damage you may sustain or cause. You are solely responsible for your own conduct on the road and for compliance with all applicable laws. To the maximum extent permitted by applicable law, you irrevocably waive, release, discharge, and forever covenant not to sue MyDL.ca and the Operator from and for any claim, demand, action, or cause of action arising from any such risk, use, or reliance.
9. AI and Translations
The Service may use algorithms and large language models ("AI") to select questions, generate or improve explanations, perform scoring, or translate content. AI output may be inaccurate, incomplete, biased, fabricated, out of date, or otherwise unfit for any purpose. You must evaluate any AI-generated content critically and never rely on it as the sole or authoritative source of truth.
Translations. Translations between English and French (or any other language) may be produced or assisted by automated tools and may differ in nuance, scope, or meaning from the original. In the event of any discrepancy between any translated text and the English version, the English version controls in all respects.
10. Service Availability and User Equipment
The Service is provided on a best-effort basis. No guarantee, representation, or warranty is made as to continuous availability, uptime, response times, freedom from errors or interruptions, data integrity, latency, throughput, or accessibility from any specific location, device, or network. The Operator may suspend, modify, throttle, restrict access to, or discontinue any feature or the entire Service at any time, in whole or in part, in any geography, without notice and without liability.
You are solely responsible for providing your own compatible device, operating system, modern web browser, and internet connection. The Operator is not liable for any data charges, hardware costs, software costs, or any other expense you incur to access or attempt to access the Service.
11. Third-Party Services and Links
The Service may contain links to, or rely on, third-party websites, services, APIs, content, or resources (including Google for sign-in and Cloudflare for hosting and content delivery). The Operator does not control and is not responsible for the content, accuracy, availability, security, privacy practices, terms, fees, or any other aspect of any third party. Following any third-party link or using any third-party feature is entirely at your own risk and subject to that third party's own terms and privacy policy.
12. Intellectual Property
All practice questions, explanations, AI-generated content, page layout, code, design, branding, names, logos, and other materials on MyDL.ca (the "Content") are owned by the Operator or licensed to it, and are protected by Canadian and international intellectual property laws. You are granted only a strictly limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to view the Content in a standard web browser solely for your own non-commercial study. You have no right to download, store, copy, screenshot, print, scrape, reproduce, distribute, modify, transmit, sell, license, sublicense, publicly display, perform, prepare derivative works from, or otherwise exploit the Content in any manner. The licence terminates automatically and immediately on any breach of these Terms.
13. Third-Party Trademarks (Nominative Fair Use)
References on the Service to "G1", "G2", "G", "Class 5", "Class 7", "Class 7L", "Learner's Licence", "ICBC", "DriveTest", "SAAQ", "MPI", "SGI", "MTO", "RMV", or any other trade name, mark, or logo of a Canadian provincial or territorial licensing authority are made solely to identify the test you may be preparing for. Those marks are the property of their respective owners. Their use here is descriptive nominative fair use only and does not imply any endorsement, affiliation, sponsorship, partnership, or approval.
14. Lives, Referrals, and Virtual Items
The "cars" (practice fleet) mechanic gates access to certain features. Cars have no monetary value, are not redeemable for cash, credit, refund, or any other consideration, are not transferable between accounts, are not your property, and may be set, modified, expired, withheld, capped, removed, or otherwise adjusted to any value at any time at the Operator's sole and unappealable discretion. Referral rewards may be reversed, withheld, or clawed back where, in the Operator's sole determination, they were obtained through fraud, self-referral, multi-accounting, abuse, or violation of these Terms or any other policy.
15. Submitted Content — Licence
To the extent you submit, post, transmit, or otherwise make available to the Service any content, data, feedback, suggestion, idea, comment, answer, or other information ("Submitted Content"), you grant MyDL.ca and the Operator an irrevocable, perpetual, worldwide, royalty-free, fully paid-up, sublicensable, transferable licence to use, copy, modify, adapt, translate, publish, perform, display, distribute, train AI models on, and create derivative works from your Submitted Content for any purpose. You waive any moral rights to the maximum extent permitted by law and warrant that your Submitted Content does not infringe any third-party right.
16. Disclaimer of Warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS", WITHOUT WARRANTY OR CONDITION OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. ALL WARRANTIES AND CONDITIONS ARE EXPRESSLY DISCLAIMED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, CURRENCY, TIMELINESS, COMPATIBILITY, INTEROPERABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MyDL.ca, THE OPERATOR, OR ANY CONTRIBUTOR OR LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, AGGRAVATED, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE OR GROSS NEGLIGENCE), STRICT LIABILITY, BREACH OF STATUTORY DUTY, OR ANY OTHER LEGAL THEORY — INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, FAILURE TO PASS A KNOWLEDGE OR ROAD TEST, EXPENSES INCURRED IN RETAKING ANY TEST, COSTS OF SUBSTITUTE SERVICES, PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF GOODWILL, LOSS OF OPPORTUNITY, LOSS OF REPUTATION, EMOTIONAL DISTRESS, OR LOSS OF USE — EVEN IF NOTIFIED OF, OR REASONABLY FORESAW, THE POSSIBILITY OF SUCH DAMAGES.
TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS, IN AGGREGATE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO CAD $0 (ZERO CANADIAN DOLLARS). THE SERVICE IS FREE; YOU HAVE NOT PAID FOR IT, AND ARE NOT ENTITLED TO MONETARY OR ANY OTHER COMPENSATION. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION OR DISPUTE IS TO STOP USING THE SERVICE.
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any limitation or exclusion is unenforceable in your jurisdiction, the Operator's liability is limited to the smallest amount permitted by applicable law. The exclusions and limitations in this section apply even if any limited remedy fails of its essential purpose.
18. Indemnification
You agree to indemnify, defend (at the Operator's option), and hold harmless MyDL.ca and the Operator from and against any third-party claim, demand, action, loss, liability, damage, judgment, settlement, fine, cost, or expense (including reasonable lawyers' fees, court costs, and settlement amounts) arising out of or relating to: (a) your use or misuse of the Service; (b) any breach by you of these Terms; (c) your violation of any law, regulation, or third-party right; (d) any Submitted Content you provide; or (e) any dispute between you and any third party. The Operator may, at its sole option and at your expense, assume the exclusive defence and control of any matter subject to indemnification, in which case you will fully cooperate with the Operator in asserting any available defences.
19. Termination
The Operator may suspend, restrict, or terminate your access to the Service at any time, in whole or in part, with or without notice, with or without reason, and with no obligation to state any reason. Termination may result in immediate and permanent loss of all account data, progress, history, cars, referrals, and any other content associated with your use of the Service. You bear sole responsibility for any consequence of such loss. The Operator has no obligation to retain, export, transfer, or otherwise preserve your data after termination.
Upon termination, you must immediately cease all use of the Service and destroy any cached or downloaded copies of any Content. Sections that by their nature should survive termination (including 1, 2, 3, 5, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 20, 21, 22, 23) survive.
20. Modifications
These Terms may be modified at any time, without prior notice and without obligation to notify you. The "Version" and "Last updated" line at the top reflects the most recent revision. Continued use of the Service after any modification — even if you have not seen or read the modification — constitutes irrevocable acceptance of the revised Terms. If you do not accept any change, your sole remedy is to stop using the Service immediately.
21. Governing Law, Jurisdiction, and Class Action Waiver
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-law principles. The courts located in Vancouver, British Columbia have exclusive jurisdiction over any such dispute, and you irrevocably submit to that jurisdiction and waive any objection based on inconvenient forum.
Class Action Waiver. To the maximum extent permitted by applicable law, you agree to resolve any dispute only on an individual basis, and not as a plaintiff or class member in any purported class, collective, mass, representative, or consolidated proceeding, and not in any action consolidated with disputes brought by other users. If a court finds this waiver unenforceable as to any particular claim, that finding does not affect the enforceability of any other part of these Terms or any other claim.
22. Severability, Entire Agreement, and Assignment
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be interpreted in the manner that most closely reflects the original intent in an enforceable form. These Terms, together with the Privacy Policy, constitute the entire agreement between you and MyDL.ca regarding the Service and supersede any prior agreement, understanding, or representation. No waiver of any breach or right is a waiver of any subsequent breach or right or of any other right. The Operator may assign, transfer, or delegate these Terms or any rights or obligations under them at any time, in whole or in part, without notice or consent. You may not assign or transfer these Terms or any of your rights or obligations under them.
23. Force Majeure
The Operator is not liable for any failure or delay in performance of any kind caused by events beyond its reasonable control, including without limitation acts of God, natural disasters, war, terrorism, civil unrest, government action or inaction, sanctions, embargo, pandemic, internet, network, or power outages, cyber attacks, or failures of any upstream service provider.
